کفالة المتهم في روما في العصر الإمبراطوري(27ق.م-284م)
عَرف الرومان منذ وقت مبکر من تاريخهم حبس المتهم بارتکاب جريمة في السجن العام(carcer), کإجراء جنائي يسبق محاکمته؛ لکي تضمن سلطات التحقيق مثول المتهم أمام المحکمة؛ وجعله سهل المرام بالنسبة للقاضي فيمکن استجوابه في أي وقت ومواجهته بالشهود. ولکن نظرًا لسوء أوضاع السجون الرومانية والمعاملة السيئة التي تعرضوا لها, ظهر في روما منذ القرن الخامس قبل الميلاد توجه يشير إلى ترفع المتهمين من الطبقات العليا في المجتمع الروماني عن الحبس في السجون العامة انتظارًا للمحاکمة, لذا أصبحت هناک حاجة ماسة للبحث عن تدبير قانوني بديل يکفل حبس هؤلاء المتهمون في مکان أخر غير السجن, وقد قرر مجلس السيناتوس(Senatus) أن يقوم المتهمين بتقديم الکفلاء (Vades dari placuit) الذين کانوا يضمنون مثول المتهمين أمام القاضي في المحکمة بدلًا من حبسهم في السجن العام. تتناول هذه الدراسة, المقصود بکفالة المتهم, وبداية ظهور تقديم الکفالة للمتهم بدلًا من حبسه في السجن, ودواعي تقديم الکفالة للمتهم, وکفالة المتهم في القانون الروماني وأنواعها, وضوابط تقديم الکفالة للمتهم, وعلاقة کفالة المتهم بالتمييز الطبقي في المجتمع الروماني, وجهة اختصاص تقديم الکفالة للمتهم, وأحوال المتهم بعد تقديم الکفالة, ومقارنة تدبير الکفالة بالحبس في السجن العام, والالتزام الذي يفرضه تدبير تقديم الکفالة للمتهم, وانتهاء تدبير کفالة المتهم.
